{"id":575,"date":"2019-11-07T00:00:00","date_gmt":"2019-11-07T00:00:00","guid":{"rendered":"https:\/\/duffyregan.co.uk\/index.php\/2019\/11\/07\/employing-someone-at-home\/"},"modified":"2019-11-07T00:00:00","modified_gmt":"2019-11-07T00:00:00","slug":"employing-someone-at-home","status":"publish","type":"post","link":"http:\/\/duffyregan.co.uk\/index.php\/2019\/11\/07\/employing-someone-at-home\/","title":{"rendered":"Employing someone at home"},"content":{"rendered":"<p>Believe it or not, HMRC will consider you are the employer of a nanny, housekeeper, gardener or anyone else who works in your home if both the following criteria apply:<\/p>\n<ul>\n<li>you hire them, and<\/li>\n<li>they are not self-employed or paid through an agency.<\/li>\n<\/ul>\n<p>If these criteria do apply this means you have certain responsibilities, like meeting the employee&rsquo;s rights and deducting the right tax.<\/p>\n<p>There are special rules for au pairs, who are not usually considered workers or employees.<\/p>\n<p>You are classed as an employer if you pay a carer or personal assistant directly, even if you get money from your local council (&lsquo;direct payments&rsquo;) or the NHS to pay for them.<\/p>\n<p>Anyone you employ must:<\/p>\n<ul>\n<li>have an employment contract<\/li>\n<li>be given payslips<\/li>\n<li>not work more than the maximum hours allowed per week<\/li>\n<li>be paid at least the National Minimum Wage<\/li>\n<\/ul>\n<p>If they meet the eligibility requirements, they are also entitled to things like:<\/p>\n<ul>\n<li>Statutory Maternity Pay<\/li>\n<li>Statutory Sick Pay<\/li>\n<li>paid holiday<\/li>\n<li>redundancy pay<\/li>\n<li>a workplace pension<\/li>\n<\/ul>\n<p>In effect, you would be treated as an employer and would need to comply with the usual obligations to register and apply the PAYE regulations.<\/p>\n<p>If you are concerned that you may be affected we can help you set up and maintain the necessary payroll records.<\/p>\n<!-- -->","protected":false},"excerpt":{"rendered":"<p>Believe it or not, HMRC will consider you are the employer of a nanny, housekeeper, gardener or anyone else who works in your home if both the following criteria apply: you hire them, and they are not self-employed or paid through an agency.
